Draft for legal review. Not yet final.

Terms

These terms apply when you buy or use LocalStore from AppsForMyCar ("we", "us"). Please read them before you book an install. If anything is unclear, email hello@appsformycar.co.nz.

1. What you're buying

LocalStore costs $499 per car, GST included, paid once. There's no subscription. The price covers:

  • installing LocalStore on your car's head unit,
  • the unlock that lets the head unit install and run apps, and
  • the LocalStore app store on the car's screen, with updates sent over the air for as long as we support your car.

Features we add later, such as the trip logbook, tracking or fleet tools, may be priced separately. We'll tell you the price before you buy them, and nothing you've already paid for will switch off because you don't.

2. One licence per car

Your licence belongs to the car we install it on, identified by its head unit. It isn't a licence for you to use on other cars.

  • If you sell the car, the licence goes with it.
  • LocalStore installed on any other car, whether copied or from another source, runs as a 14-day trial. After that it asks for payment, and its paid features switch off until the car has its own licence.
  • Paid features switching off never stops the car, its screen or its built-in systems from working.

3. Installation

  • We install in the Auckland region. Wellington and Christchurch are planned.
  • You must own the car, or have the owner's permission to have LocalStore installed.
  • We only install on cars we list as supported. If we find on the day that we can't complete the install on your car, you pay nothing, or we refund you in full.
  • Installing doesn't involve taking the dash apart or changing the car's driving systems.

4. Head-unit software updates

Your car's maker, dealer or an over-the-air update can change the head unit's software at any time. An update can uninstall LocalStore, undo the unlock or remove apps you've installed, and can change how the head unit works so that LocalStore no longer works on it. It may also stop us from installing LocalStore again. We don't control those updates and can't promise that LocalStore or the unlock will work after one.

If an update affects LocalStore, contact us. If we can restore it, we'll tell you what that involves, including any cost, before we do anything. We won't advise you to avoid updates that affect your car's safety.

5. Apps

  • Apps come from their own stores or developers, under their own terms. We don't make or sell them, and paid apps are bought from their developers.
  • Google Play apps are installed through Aurora Store, which signs in anonymously by default. You can sign in with your own Google account if you choose. Google may limit or refuse downloads from time to time.
  • "Tested and working" means an app ran on our own car when we last checked. Developers change their apps, and we can't promise that any app will keep working, or work the same way it does on a phone.
  • Apps that rely on Google services may run with a compatible replacement, and some may not run at all.

6. Using apps safely

You're responsible for using the screen safely and lawfully. Don't watch video, play games or handle apps in ways that take your attention off the road while driving. Set up navigation and music before you set off.

7. Your car and its warranty

LocalStore changes software on the head unit, not the systems that drive the car. Your car's maker or dealer may still decline a warranty claim about the head unit while LocalStore is installed. If your warranty matters to you, check with your dealer before booking. LocalStore and the apps it installs can be removed, and we can remove LocalStore for you.

8. Updates and support

We send LocalStore updates over the air. Every update is signed by us, and your car refuses any update that isn't. We may stop supporting a car model, and may give notice when we do. LocalStore keeps working after support ends, without new updates, unless a head-unit update stops it (see section 4).

9. Your rights

If you buy LocalStore as a consumer, you have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 that these terms don't take away. That includes a remedy if our service isn't carried out with reasonable care and skill, or isn't fit for the purpose we described.

If you buy LocalStore for a business, you agree that the Consumer Guarantees Act 1993 doesn't apply, and that sections 9, 12A and 13 of the Fair Trading Act 1986 don't apply, to the extent the law allows and it's fair and reasonable.

10. Our liability

To the extent the law allows, we're not liable for loss caused by things we don't control. This includes head-unit updates, apps made by others, Google or app-store changes, and how the car is used. Where we are liable, our total liability is limited to the price you paid for LocalStore on that car. Nothing here limits liability that the law doesn't allow us to limit.

11. Your information

Our privacy notice explains what LocalStore sends us and how we use it.

12. Changes to these terms

We may update these terms. Changes don't take away anything you've already paid for. We'll post the new version here with its date, and email account holders about significant changes.

13. Contact and law

Questions or complaints: hello@appsformycar.co.nz or our contact form. These terms are governed by New Zealand law.
